Importance and role of the implementation of Turquoise Card in terms of Turkish foreigners law

Many states have adopted some regulations to facilitate the employment of highly skilled foreigners and aimed to turn the destination of skilled labor mobility to their country, by taking into account the superior added value created by highly skilled people. In line with this purpose, many developed and developing countries have chosen to subject the employment of skilled foreigners to simpler and faster procedures as compared with the typical foreigners. Nowadays, besides traditional immigration countries, it is seen that even some European countries known for their strict immigration policies have adopted some special programs to attract highly skilled migrants to their countries. The most outstanding Programs in this regard are the US Green Card (EB-1 or EB-2) and the EU Blue Card. Besides the card programs, many countries have their own national programs to facilitate highly skilled foreign employment. Under the influence of these trends, Turkiye has created its own national program under the name of "Turquoise Card", inspired by many issues related to the US Green Card and the EU Blue Card. In the first part of our thesis, general provisions of the Turkish law regarding the employment of foreigners will be examined. In this context, in order to indicate the exceptions of Turquoise Card, other work permits will be discussed in general terms, and after that, the limitations on the professional activities of foreigners in Turkey will be analyzed. In the second part of our thesis, the emergence of skilled migration and its basic elements will be briefly discussed; the criteria to be taken into account in assessment of superior qualifications of foreigners in the US Green Card and the EU Blue Card, which have the widest area in comparative law, will be examined in detail, in order to create a possibility for comparison with the Turquoise Card. Following these, the formation process of Turquoise Card and the international labor policy of Turkiye, that Turquoise Card will serve as a tool of it, will be examined in the line with criteria to be taken into account in the determination of this policy. In the third and the last part of our thesis, foreigners who may be evaluated within the scope of Turquoise Card program, will be examined toward the criteria to be taken as basis in determining the qualification in the Code no. 6735 and the Turquoise Card Regulations of the Ministry of Labour and Social Security (Turkey); and the provions regarding the process of the Turquoise Card program will be examined and the application, evaluation and cancellation processes will be tried to be clarified. Finally, the exceptional aspects of Turquoise Card program will be presented.
