Abstract (EN)
The environment is a concept and phenomenon in which a person has existed since the beginning of time, has an element, and is constantly in contact with. The human-environment relationship has continued since the existence of humans. Even though both parties in this interaction have an impact on each other, individuals have had a greater impact on and transformed the environment. In the early days, the environment, which had been impacted by human activities, was able to control the impacts of harmful human activities within its own system, and no unfavorable scenario arose. However, when the intensity of negative human activities increased, the environment was unable to manage the effects of these negative activities within its own system, and long-term environmental issues began to emerge. Despite environmental issues, people in the early days managed to remain unconcerned about these issues and the environment. When environmental problems became unsustainable and had a negative impact on human and economic life, environmental concerns and issues began to rise to the top of people's agendas. Meanwhile, many methods and technologies for solving environmental problems, protecting the environment, and developing it have begun to be developed. One of these solutions and tools has been legal tools. In this study, after providing general environmental explanations, legal instruments relating to the environment were investigated in depth. The historical approach is used to deal with the theoretical conceptions and theories, while the descriptive research method is used to deal with the practical equivalents of the theories. After that, judicial decisions were used to conduct a qualitative study of the legal instruments reviewed in terms of environmental protection and development. As a result, Turkey's legislative instruments and judicial decisions have been assessed.
