Abstract (EN)
In the wake of technological advancements, the advent of electronic commerce (e-commerce) has introduced a novel paradigm in trade characterized by its capacity to transcend international borders. Despite the manifold conveniences and advantages conferred by the emergent modes of commerce facilitated by e-commerce, they have concurrently engendered a host of uncertainties and challenges. Chief among these challenges are issues pertaining to technical infrastructure, legal frameworks, and, of paramount significance, the taxation of transactions within the realm of e-commerce. The fundamental divergence in the structure and modus operandi of e-commerce vis-à-vis traditional commerce has rendered conventional tax systems ill-equipped to assimilate the intricacies of e-commerce transactions, thereby hampering their capacity to effectively regulate such commercial activities. The principal objective of this scholarly inquiry resides in a comprehensive exploration of the concept of electronic commerce and its multifaceted ramifications within the purview of taxation. The study is poised to illuminate the intricacies of e-commerce, expose the concomitant challenges it poses, and endeavor to cast light upon potential solutions amenable to addressing these issues. The scope of this research encompasses a nuanced examination of the conceptual underpinnings and practical applications of e-commerce. Furthermore, it delves into an exhaustive review of both domestic and international endeavors aimed at implementing e-commerce applications and ameliorating the challenges they give rise to. The study also extends its purview to include a detailed exposition of the relevant organizations engaged in these pursuits on a global scale, as well as within the Turkish context. Integral to the analysis is a comprehensive assessment of the legal infrastructure underpinning e-commerce within the Turkish jurisdiction. Subsequent to the presentation of this comprehensive information, the study proceeds to undertake an incisive appraisal of the tax regime governing e-commerce in Turkey, encompassing various facets of taxation within the framework of extant legislation. This evaluative exercise is intended to elucidate the lacunae and complications attendant to the current legal framework in Turkey concerning the taxation of e-commerce across multiple tax categories. The culmination of these evaluations serves to bring into sharp relief the issues precipitated by e-commerce within the existing fiscal framework, thereby affording insights into the challenges that require redress within the ambit of contemporary tax legislation.
