Abstract (EN)

The right to strike is a component of freedom of association, complement to right to collective bargaining and the main organ for protecting the economic and social interest of employees. The right of politics is a right that has both collective and individual dimensions, allowing for participation in political life, decision- making processes and government. However, everyone cannot benefit equally from the trade union and political rights that constitute the essence of freedom of association and political participation. At this point, the conflict created by the dual status of public officials, both citizen and public servants, is being tried to overcome by prohibitions and restrictions on area of political and trade union rights. Particularly, when ıt comes to strikes and political rights, in utility department ıt is directly decided to ban. This situation makes the field of trade union and political rights become a question of open debate in terms of public officials. The reason is cautious approach to these areas and the inadequacy of solutions. Constitutional and legal arrangements in our country, there are restrictive and prohibitive provisions in order to ensure continuity in public service and prevent politicization. This situation creates a problem of compliance with universal standards of strike and political rights in the implementation of rights. Therefore, the purpose of our study make general evaluation by examining the prohibition of strikes and politics in the context of international norms and regulations. As a result of evaluation, ıf there is, to point out the missing aspects and to give an opinion about whether the rights will be recognized or not.
