Difference of judicial and administrative law enforcement in the context of public administration and security in Turkey: The case of Bismil and Ergani

In the context of public administration and security, it is observed that the relations between law enforcement activities and judicial services are mostly mentioned in the academic studies and published articles and studies are carried out at this point. However, with this targeted study, a systematic branch/unit-oriented distinction is observed, different from the current academic studies, by focusing on the distinction between judicial and administrative law enforcement rather than the relationship between judicial and administrative law enforcement activities and judicial services. It carries out the law enforcement/security activities carried out by the administration through certain units. Chief among these security units is the Police and Gendarmerie Organization, which carries out internal security activities (external in extreme/special cases). Therefore, the said study will be carried out within the scope of the Security and Gendarmerie Organization. The study carried out by addressing the historical development of the concept of law enforcement, its types, the distinction between judicial and administrative law enforcement, the problems in the theory and practice of judicial and administrative law enforcement, the analysis of legislation related to law enforcement, and thus the conclusions and suggestions, revealed the optimal benefit that the separation of judicial and administrative law enforcement will bring in justice and security services. attempted to be removed.
