Abstract (EN)
This study aims to examine the detailed legal regime of the statutory decree in Turkey. For this reason, in the first chapter of the study, a study has been carried out for explaining the concept of the statutory decree, revealed different opinions in the doctrine on the subject and legal characteristic and conditions. It has been tried to explain with a historical point of view the relation of entrance of the concept of statutory decree in Turkish Legal System and such as transactions. In the second chapter, the statutory decrees in ordinary period had been examined with the framework of empowering laws and other elements has been dwelt on presented to the Turkish Grand National Assembly and the principles of negotiation. In the last part of second chapter, the judicial reviews of the statutory decrees in ordinary period has been tried to explain with sample jurisprudence of the Constitutional Court.In the third and last chapter, the statutory decrees in extraordinary period like in ordinary period had been examined with the framework of authorization and other elements, the differences between the statutory decrees in ordinary period were tried to be mentioned in the subject. Finally, the subject of judicial review of the statutory decrees in extraordinary period was examined.
