Abstract (EN)
In case of unexpected general danger that requires immediate action to preserve the existence and authority of the constitution, the governments are supposed to be equipped by some privileged authorization. As a matter of fact, when we consider comparative law, today in the judicial system of almost all of the countries which are regarded as democratic state of law, it is seen that the state of emergency regime which provides these privileged authorization to the government is handled. As a result of the application to this regime, the intervention of fundamental rights and freedoms at a higher level than normal is a natural consequence of the regime and it is given place to this natural result in the constitution of the state of the Republic of Turkey. The aim of this study is to show the system of suspension of fundamental rights and freedoms in Turkey's state of emergency and the reflection of the recent constitutional amendments to this system.
