Abstract (EN)
In this study, our focus is on the Islamic scholar Sadr al-Sharia Ubaydullah b. from Bukhara, renowned as one of the eminent figures of the Hanafi jurisprudence, who earned recognition under the epithet 'Second Sadr al-Sharia.' We delve into the position held by Mes'ud (d. 747/1346) within the realm of fiqh and his seminal work titled 'Sharh al-Wiqaya.' Sadr al-Sharia's composition garnered attention within scholarly circles and has served as a reputable source for centuries. In the Transoxiana region, during the 13th and 14th centuries, Sadr al-Sharia Ubaydullah b., distinguished him self among scholars of the 19th century by engaging in independent jurisprudence and played a significant role in upholding the methodologies and principles of the Hanafi school. Mes'ud emerges as a revered fiqh figure among mujtahids of his era. A genealogical record of Mes'ud indicates his lineage tracing back to a renowned family of scholars. Among his ancestors, one notable figure is Cemaleddin Ubeydullah b. Ibrahim al-Mahbûbî (d. 630/1233), commonly known as "Ebû Hanîfe es-Sânî," who held prominence as a leading scholar of the Hanafi school during his era. Given that both paternal and maternal grandfathers of Sadrüşşeria shared the name Sadrüşşeria, the epithets 'al-Akbar' and 'al-Awwal' were appended to his great-grandfather's titles, while 'el-Esgar' or 'es-Sânî' were attributed to Sadrüşşeria himself. In our thesis, we utilized various manuscripts of the Arabic work "Şerhu'l-Vikâye," sourced from the National Library in Ankara, Turkey, and the Imam Bukhari International Research Center in Uzbekistan. Specifically, we relied on the copy titled "Serhu'l-Vikâye: Müntehe'n-Nükâye 'ala Şerhi'l-Vikâye," as researched by Salâh Muhammed Ebü'l-Hâc, as the primary basis for our study. The aim of this study is to determine the position of the work 'Şerhu'l-Vikâye' within the fiqh literature by conducting evaluations on its place in Islamic law and the contextual conditions of the period in which it was authored. Furthermore, this study will examine issues such as Sadrüşşerîa's contributions to Islamic law, his sources of fiqh, his methodological approach, the key points he emphasized in his work, and his relationship with the views of previous jurists, based on 'Şerhu'l-Vikâye.' Such analysis is crucial for understanding the significance of 'Şerhu'l-Vikâye' within the broader framework of Islamic jurisprudence and its scholarly discourse.
