Abstract (EN)

After the Second World War victorious allied countries able to form the international military tribunal to prosecute the war crimes in Nuremberg and Tokyo. Despite criticism because it was found by victorious allied government it could able to contribute positive outcome to international law. In this thesis, the establishment of the former Yugoslavia and Rwanda and the other adhoc international tribunal courts was founded by the decision of United Nations Security Council. And this process played a significant role to fasten the foundation of international criminal court. As the same time the International Criminal Court is universal, independent, permanent and the individual that involved in crimes and the legal procedures that take place in the main countries are also included. In other side the Soviet Union war in Afghanistan, and the civil war between competing forces and together with the outcome of 9/11 attack and the new wave of war that Taliban waged against government and investigating the crimes that has been commuted during the arms conflict from all sides. Keeping these purposes in mind, Afghanistan as a member of International Criminal Court the preliminary investigation that has been undertaking by the Office of the Prosecutor to maintain peace and justice is to keep the constitutional stability of Afghanistan. As the same time, investigating the peace, security and stability related problems and corruption in governmental institution.
