Right to education of refugees and asylum seekers in international law

According to the 1951 Geneva Convention Relating to the Status of Refugees, a refugee; is defined as a person who leaves the country of his citizenship because he fears that he will be persecuted because of race, religion, nationality, membership of a certain social group or political opinion. While an asylum seeker is a person whose asylum request has not yet been concluded by the competent authorities. Many other human rights instruments, in addition to the 1951 Geneva Convention, sets forth the rights of refugees and asylum seekers. Among these rights, the right to education stands out as a right that transforms and empowers individuals and ensures self-sufficiency. The right to education, which is crucial for refugees and asylum seekers, has been examined in this thesis in light of international human rights instruments. Within the scope of the thesis, the misused concepts in practice in refugee law are explained and the historical development of refugee law is laid out. In the second part, the importance of the right to education for refugees and asylum seekers and the human rights documents that include the right examined. Finally, the right to education of refugees and asylum seekers has been examined in the light of the European Court of Human Rights Decisions.
