A research in Fidik conditions which are exemplified in international biddings and Turkish case

FIDIC (International Federation of Consulting Engineers - FederationInternationale Des Ingenieurs Conseils) was founded in 1913 in Lausanne inSwitzerland. The federation prepared FIDIC Conditions in 1957 to be applied inconstruction contracts. FIDIC made some amendments in the Conditions in1999 and published 4 exemplary Conditions: Condition of Contract forConstruction, Condition of Contract for Plant and Design-Build, Condition ofContract for EPC/Turnkey, Condition of Contract for EPC/Turnkey and Shortform of Contract.At the present time, World Bank and the other credit institutions demandsthat FIDIC Conditions are to be used in the works that they are financing.Moreover Turkish Engineering and Construction Firms have made contractsaccording to these conditions since 1972.FIDIC mainly aims to provide equilibrium between employer andcontractor and especially aims to make support to contractor against employeras envisaged in Turkish Dept Law.FIDIC Conditions anticipate that controlling function should be fulfilled byindependent real or judicial persons that are other than contractor. Controllinginstitutions are called as Engineer or Counselor and involves in all parts ofbidding, and undertake very important duties.In this thesis, FIDIC Conditions, that are exemplified in InternationalBiddings, and Turkish practice were examined. In the first part of the theses,biddings and contracts in Turkish Law was discussed. In the second part of thetheses, FIDIC Conditions were discussed in a broad sense and Turkishpractices were examined.
