Abstract (EN)
As any dispute arises between persons, it is the state and courts of general jurisdiction / courts generally applied for the resolution of the dispute. Excessive workload, judges are not experts in the subject, etc. For reasons, due to the long duration of the proceedings in the courts, the way to resolve the disputes is arbitration. Arbitration in international trade disputes, especially in the world and in Turkey is a road frequently referenced. However, in international commercial disputes, the issue of dispute becomes complicated, the parties are more than one, etc. the reasons caused the prolongation of the arbitration proceedings. The development of the internet and technology has led to innovations in arbitration, and mail and decisions have been forwarded electronically, and tele-conference method has been started with hearings. Thus, classical arbitration has been replaced by electronic arbitration in order to resolve the dispute. The subject of our study is Electronic Arbitration Applied in International Commercial Disputes and will be examined in three sections. In the first section, arbitration is mentioned conceptually and the types of arbitration are discussed. In the second part, electronic arbitration practice is mentioned in general and the rules of corporate arbitration centers that have electronic arbitration applications in the world are explained. In the same section, electronic alternative dispute solutions are briefly discussed and the reasons for choosing electronic arbitration are explained. In the third chapter of the specific problems of electronic arbitration, arbitration was mentioned electronic applicability in Turkey. In the last part I completed my studies make proposals for the development of electronic arbitration implemented in Turkey.
