Ususfructuary lease contract

Although, the historical origin of The Ususfructuary Lease which regulated by the Turkish Code of Obligations art.357 ff., that comes from Roman Law to modern-day, based on a lease of land, In these days, it is a typical and special lease contract which includes lease of enterprises and copyrights. In this research, the ususfructuary lease was studied on its elements, rights and obligations and the regime of termination as a whole, and it is tried, to emphasize the close link with ordinary law of lease and to offer a suggestion about the protection of tenant of ususfructuary lease. At this perspective, making research on artificial distinctness which is between ususfructuary lease and other lease contracts, the principle of protection of tenant were studied from the point of view of the implementation of the tenant of ususfructuary lease.
