Abstract (EN)

The issues regarding the determination of the international borders of the newly independent states are quite complex. In this process, the most applied international law principles are uti possidetis juris and territorial integrity principles. After the collapse of the Union of Soviet Socialist Republics, there were serious problems in determining the borders between the newly independent states in the region. Conflicts between the state and minorities in the former Soviet region have led to major conflicts that are still unresolved. The Nagorno-Karabakh problem, which started since the years of independence of Azerbaijan and still has not been concluded, is one of the problems that maintains its existence as a serious conflict at the international level. In this process that has been going on for more than thirty years, the territorial integrity of Azerbaijan and the principle of uti possidetis juris have been clearly violated. In order to end this process, Azerbaijan used its right of self-defense in the Second Nagorno-Karabakh War in accordance with Article 51 of the UN Treaty and liberated most of its occupied territories from occupation. The main purpose of this study includes research on the correlation of uti possidetis juris and territorial integrity principles based on international law in the Nagorno Karabakh example. In addition, in the study, the cases in which the mentioned principles were applied as the basic principle were examined and related to the Nagorno-Karabakh problem and these cases were evaluated within the framework of international law.
