Abstract (EN)

Crimes related to drugs or stimulants are defined in the Third Section of the Third Part of the Turkish Penal Code No. 5237, which regulates Crimes against Society, entitled "Crimes against Public Health", m.188 et seq. in its articles, the manufacture and trade of drugs or stimulants, the purchase, acceptance or possession of drugs or stimulants to facilitate the use and use of these substances, or the acts of using drugs or stimulants are regulated as crimes by the legislator. The subject of our study, TCK m. 188 with the crime of manufacturing and trading drugs or stimulants, m. It constitutes the crimes of facilitating the use of drugs or stimulants regulated in 190. The production, use or trade of drugs or stimulants creates serious dangers for both individual and public health. The fight against drugs or stimulants has moved to an international dimension over time, and the fight against these substances continues with the international agreements signed between countries and the regulations made in our national legislation. Within the scope of our study, firstly the definitions and types of drugs or stimulants were mentioned, international agreements signed in this context were mentioned, and then TCK art. 188 and m. The basic and qualified elements of the crimes regulated in 190, special appearance forms such as congregation and participation, sanctions and effective repentance are included under separate headings.
