Abstract (EN)

Crimes of manufacturing and trading narcotic and stimulant substances are regulated in the "Crimes Against Public Health" section in the third section of the "Crimes Against Society" section of the Turkish Penal Code. The protected legal interest is public health and the entire society damaged by the crime. For this reason, it is not a crime subject to complaint, its investigation and prosecution are carried out ex officio. In practice, disagreements are frequently encountered in determining the intent of the perpetrator, determining the nature of the action, separating the crime committed from use crimes, applying effective repentance and determining the punishment. Although there are regulations on the subject in the Turkish Penal Code and some of the laws we mentioned in our study, the opinions in the doctrine and the practices of the Supreme Court provide guidance in the evaluation of the crime. In the first part of our study, the types of narcotic and stimulant substances, their historical development, international agreements and societies, and their place in comparative law were examined. The second part of our study includes a detailed examination of the qualification of crimes of manufacturing and trading drugs and stimulants, and in the third part, the procedure, sanctions and statute of limitations are examined.
