An analysis of Turkish legislation and political party statutes in the context of the Venice commission's recommendations on political parties

The principal aim of this study is to examine the extent to which the Code of Good Practice in the Field of Political Parties, prepared by the Venice Commission and recognized as a significant source of European Union legislation, corresponds with the legal framework governing political parties in Turkey, as well as with the statutes of major political parties. To this end, the Constitution of the Republic of Turkey, the Law on Political Parties, the Law on Basic Provisions of Elections and Voter Registers, and the Rules of Procedure of the Grand National Assembly of Turkey have been analyzed. Furthermore, the statutes of the principal political parties of a competitive and institutional character (AKP, CHP, MHP, Felicity Party, DEM, and İYİ Party) were examined within the framework of the core criteria derived from the aforementioned document: (1) Principles of Organization and Establishment, (2) Rule of Law, Democracy, Equal Treatment, and Transparency, (3) Internal Structure and Membership, (4) Financing and Resources, and (5) Political Ethics, Anti-Corruption, and Transparency Mechanisms. The analyses, carried out through descriptive, document analysis, and comparative methods, demonstrate that the aforementioned constitutional and legal provisions, along with party statutes, exhibit a considerable degree of consistency with the principles of the Venice Commission. However, such alignment appears to be confined to certain thematic areas. Notably, significant room for improvement remains in the domains of political ethics, intra-party democracy, gender-equal representation, and transparency mechanisms.
