Özet (EN)

Right to Conscientious Objection; It is a concept that includes sociological, philosophical, military, economic and psychological elements. This right can simply be defined as opposing compulsory military service and its practices. The practice of compulsory military service, which deeply affects the lives of individuals in many countries around the world, and the legal dimension of the right to conscientious objection that has developed against this practice will be discussed in the study; Explanations will be made about the birth, development and current situation of the right. The recognition of conscientious objection as a right has been achieved as a result of resistance in almost all countries. As a result of this determined resistance, today, all Council of Europe and European Union member countries, except Turkey, have accepted conscientious objection as a right. The study also includes the struggle for conscientious objection in the United States, Germany, Greece, England, Israel, Russia, Iran, China, Spain, Mexico, Netherlands, North Korea and South Korea. Undoubtedly, today's democratic states agree that conscientious objection is a right. By accepting conscientious objection as a right, Turkey must fulfill the obligations imposed on it by the international institutions and agreements to which it is a party and must preserve its identity as a democratic state in the international arena.
