Abstract (EN)
There is legal uncertainty in determining the applicable law to prescription periods in actions of recognition and enforcement of foreign judgements and awards. This uncertainty exists both under Turkish law and comparative law. Given the impact of prescription periods on the fundamental right to seek legal remedies, the issue of determining the applicable law becomes far more significant. In light of this, the challenge of determining the applicable law to prescription periods in actions of recognition and enforcement of foreign judgements and awards is addressed in this thesis.
