Deporting of foreigners

Deporting procedure, is an exception in point of view of foreigners' law with the law extradition, of tha personal inviolability and security as required by law in the 19th paragraph of the Law Constitution. In Turkish Law System, it is required by law that only real "foreigners" could be deported. The main of this work is to bring up from the point of view of international agreements with the instituation of deporting of foreigners and territorial law.The concept of deporting, historical development, sources, legal quality and the procedure of deporting, from the point of view of research of both interior law are international agreements constitute the content of this work.In the mentioned work, deporting of foreigners is researched. Then, the procedure of deporting is taken charge of determining the territorial law texts, after that the international agreement decision about the case is evaluated.In the territorial law; the arbitrament of deporting foreigners, determining the Law Constitution, The Law of Travelling Accomodation of Foreigners, Passport Law, Turkish Citizenship Law, The Law About Punishment Execution and New Turkish Punishment Law Arbitraments, however through international field; The European Agreement About Protecting Main İndependences and Human Rights and Attachment Protocols, International Agreement About Personal and Political Rights, European Accomodation Agreement, European Social Circumstance, 1951 Dated Agreement of Geneva About The Refugees' Legal Condition, and About 1954 Dated Stateless' Legal Condition Agreement Arbitraments are tried to be explained in point of view. At the same time, all of these law texts made up our work's boundary.In consequent of the work researched, it's seen that the procedure of deporting is an administrative process and is fulfilled by the administrative authority. In the agreements about deporting procedure, it is clear that maintaining the public regularity is the general reason of deporting. It will be suitable to regulate some securities arranging the legal regulations in the rank of getting procedure of deporting because of not giving enough security to the foreigner who is exposed to the mentioned procedure. However giving these securities, it has to be paid attention to the international agreement which are parts of the territorial law.
