Abstract (EN)

Subject of our study is '' acquisition of real estate in Turkey by foreigners ''. From the past to the present day, under the legal rules to which foreign natural and legal persons are subject; the acquisitions of real estate in the territories of the Republic of Turkey are analyzed. Our study consists of two chapters. In the first chapter, explanations are introduced concerning the historical process of acquisition of real estate by foreigners. At the second chapter of our study, the main law on the acquisition of foreigners' real estate in Turkey, the land register law under number 2644 and its necessary conditions after its change numbered 6302 in the year of 2012 by the article 35 are examined. The most attractive part here is that the principle of reciprocity was outside the application. By the Lausanne agreement of 1923, instead of the equality brought about by Safer's law; the principle of "reciprocity" has taken its place which will be applied for a long time in the Turkish jurisdiction. The principle of "reciprocity" applied since 1923 has been replaced by a change made in 2012 and became a legal condition. By this new regulation, the condition of acquiring a real estate or limited real rights for foreigners was changed as follows; You must be a citizen of the countries defined by the President of Turkish Republic, according to the necessities requiring "the interests of the country" and "international reciprocal relations".
