Özet (EN)

International trade allows countries to access goods and services that are not available domestically while also helping them expand their markets. With the development of communication via the internet, international trade has become more efficient, and faster. With the transition of commerce to the electronic environment, the legal relations between the parties have started to diversify through electronic contracts and smart contracts on various platforms. Developments in the internet and communication tools have brought speed, practicality, and efficiency. Today, a significant part of international trade is carried out electronically. While electronic commerce facilitates the relations between the parties, it also brings legal disputes. At this point, the issue of which authorities have jurisdiction comes to the fore in disputes arising from electronic trade relations between the parties that contain foreign elements. In this study, which court is authorized in e-commerce relations containing foreign elements will be determined. Since today's state proceedings cannot meet the needs in international e-commerce relations, alternative dispute resolution methods that are suitable for these disputes will be evaluated and among these dispute resolution methods which one brings the ideal solution will be discussed.
