Comparative analysis of Public Procurement Law no. 4734 and fidic (Red book) standard contracts in construction auctions

Topics criticized in procurement rules, Turkey has tried to be the world standard with the new arrangements. FIDIC Rules were also used in this process. The public authority did not abandon such a sector of great importance and set certain standards for construction works subject to public procurement and private sector construction investments. In order to ensure equality among all public institutions throughout the country, especially in public works, type specifications and contracts have been prepared. 4734 Public Procurement Law and the basic principles introduced by the legislator; transparency, competition, equal treatment, reliability, confidentiality, public supervision, meeting the needs under appropriate conditions in a timely manner and efficient use of resources. In international relations, it is stated that an international agreement should be prepared in the face of the difficulty of providing the unity of opinion and understanding in terms of law, customs and custom of the parties, sometimes citizens of two different nations, and such a contract called FIDIC is called International Federation of Consulting Engineers" and prepared by the International Federation of Building and Public Works (FédérationInternationale du Bâtimentet des Travaux Publics) and published in 1957. In our country, in the second part of the Public Procurement Contracts Law (KİSK-4735), Type Agreements published in the Official Gazette on procurement of goods or services and construction works have been prepared in order to ensure the unity of implementation with international agreements and it is stated that these contracts should be used. In this study; A study will be carried out for the comparative analysis of FIDIC contracts applied in international projects and 4734 Public Procurement Law used in public works.
