Bolivia's constitution of 2009: A distinct constitutional process with its making process and contents

Today, when countries often make new constitutions or go to reforms in their existing constitutions, comparative constitutional law studies make it possible to reach some common values in the sense of constitutionalism by evaluating the constitutional problems and solutions of other countries. The process leading up to the 2009 Constitution of the Bolivian Multiethnic State with its current official name is worth examining in terms of comparative constitutional law as the social movements and the emerging text of this process point to a different experience of pluralism, locality, environmental emphasis and broader rights and freedoms It carries many data in its place. The purpose of this study is to shed light on this different experiment by presenting this data. The thesis consists of four parts. In the first part, the position of the 2009 Constitution of Bolivia in terms of constitutional movements is determined. The second part deals with the historical background and the process of making the constitution which lead to the making of the constitution. In the third chapter, the ideology of the constitution, the political powers and the country's own presidential system are examined, while the fourth and the last chapter examines the differences between the rights and freedoms, the mechanisms of protection of rights and freedoms and between text and practice and the criticisms arising therefrom.
