Urban transformation in the light of judicial decisions

Urban transformation is encountered in the elimination of the problems caused by economic, environmental, cultural and migration factors. In this context, urban transformation projects play an important role in solving urban problems. Urban transformation should be based on sound legal foundations in order to function systematically. Hese legal foundations are the legal basis of the concept of urban transformation. Within the framework of these legal basis, the problems of urban transformation projects have been solved by lawsuits. Purpose of the research; cases of court cases on the basis of court cases of urban transformation cases in the administrative courts, cities and the interpretation of the data obtained from the case results. In the context of the application, examples of cases related to urban transformation were obtained from the database of Lexpera internet resource. As a result of the data obtained, it has been determined that the total number of urban transformation cases in administrative courts is 1264. On the basis of the court, the highest number of cases were found in the court of cassation. The lawsuits filed within the scope of the five courts were examined within the scope of cities. As a result of this study, the number of cities where urban transformation cases are seen is 36. Among these 36 provinces, the city with the highest number of cases in terms of density was found to be Ankara. As a result, it is seen that urban transformation is a phenomenon that is much more encountered in the cultural diversity, intensive migration and population density. The interpretations of the obtained data are discussed in detail in the last section.
