Disciplinary and criminal investigations of faculty members in higher education in the ligt of judicial decisions

With these thesis, pursuant to the prevision in the 53 rd article of law numbered 2547, disciplinary proceeding of Higher Education Staff governed by the regulation disciplinary actions of Higher Education Staff under the regulation. The said regulation by the Constitutional court, 38. 128 and 130 articlesas a result of its cancellation on the grounds that it is incompatible with this articles. Considering that the Law No: 2547 has been completely rearranged with article 53, disiplinary investigation of Faculty Members working in higher education institutions due to disiplinary offenses and their duties related to the same article, taking into account the procedures and qualifications of criminal investigations and judical decisions examination has been concluded. In this context in the first part of the study which was prepared in three parts, the consept of discipline and general principales of disciplinary offenses and disciplinary law were examined. In the second part if this study which acts of teaching working in higher education institutions are defined as disciplinary offensses in the Higher Education Law No: 2547 and after briefly mentioning to the punishments to these acts, the way to be followed in the investigations due to lack of discipline of the lecturers. The priciples to be considered in the investigations and procedures to be established as a result of the investigation were examined together with the judicial decisions. In the 3. part which is the last part. The investigative system adopted by Law No: 2547 in criminal investigations of Academic Staff, operating in Higher Education İnstitutions, the authorities, authorized to carry out such investigation to procedures to be followed the powers of those carriying out the investigations concerned following the investigation and the recourse to such decisions were examined together with the judicial decisione.
