Abstract (EN)
Even though private educational institutions are the ones where state monitoring and auditing are intense due to the fact that their activity fields are related to education and instruction, it is in essence stated in the Law No. 5580 for Private Education Institutions which has abolished the Law No. 625 for Private Education Institution and was enacted in 14.02.2007 that the workers in these institutions are subject to the Law No. 4857 in terms of personal rights. However, the fact that the concept of personal rights is not clear enough, administrative authorities are intervening in business relations, it is referred to Civil Servants Law No. 657 in some articles etc. Creates a big problem in application in terms of the workers` rights and obligations. In this study, legal problems encountered in business relations established with educational staff employed in private education institutions have been examined in the light of judicial decisions. In the first section, in general, the differences between Law No. 625 and Law No. 5580, the details of the concept of private education institutions, and the scope of Law No. 5580 were mentioned. In the second section, labour agreements made with private school teachers employed in private schools where Law No. 5580 has been widely implemented have been evaluated in details. In the third section of the study, labour contracts made with expert tutors and qualified instructors in scope of Law No. 5580 where many different decrees regarding determination of both authorized judicial remedies and rights and obligations have been examined. In the last section of the study, the effects of Covid-19 pandemics foreseen to cause different problems in application in the future on the personal rights of education staff working in private education institutions have been evaluated.
