The crime of simple sexual abuse in the light of the Supreme Court decisions

The subject of our thesis is to protect children, who should have the most important place in society, in the best possible way, and to prevent acts of abuse against children by increasing awareness in Turkey, and to provide more comprehensive protection by improving the prevention environment with social action. The contracts, laws and relevant regulations to which Turkey is a party constitute the general framework of our study. One of the main problems of Turkey is the "crime of sexual abuse of children". The psychological, physical and mental development and age of the minor are important in terms of the way this crime occurs. In addition, the punishment will be determined according to the manner in which the sexual act directed at the victim child took place. In this context, the nature of the contact directed to the physical integrity of the victim child is concerned. If the sexual act occurs with a sudden movement, it will be referred to as "molestation", and if it exceeds the sudden movement, the crime will be referred to as a "simple" form. If the sexual act is committed "by inserting an organ or other object", it will be considered "qualified". All these issues were evaluated in line with the decisions of the Supreme Court. These issues were examined in detail in our thesis study. In our thesis, legal regulations, deficiencies and errors in these regulations, their scope and implementation, and the problems encountered during or after this operation are included in the light of the Supreme Court decisions. A distinction is made according to the distinction of the crime from other similar crimes and the classification and age limit of the "crime of sexual abuse of children" in the text of the law.
