Abstract (EN)
Unions that are organized in the workplaces take their power from the number of members. The more members of the unions, the more pressure they can put on the employer side. Workers gathered around strong structures get wages, benefits and a working environment in better conditions thanks to unions. In addition, it limits the employer's understanding of arbitrary management and termination rights with the collective agreement carried out by the unions. Some employers, who are under financial obligations with such strong structures and whose arbitrary behavior is restricted, are acting to weaken the union order established in the workplace. For this reason, employers can discriminate against the employee in the recruitment, continuation of the work and in the termination stages of the employment contract. In order to prevent union discrimination, various regulations have been made in Article 25 of the Law no. 6356 on Trade Unions and Collective Bargaining Agreements. The most important sanction of law no. 6356 in order to prevent union discrimination is the right to union compensation. Union compensation is a type of criminal sanction that will be applied against the restrictor if the union rights of the worker are restricted at every stage of the business relationship. The only way to qualify for such compensation is through union compensation lawsuits.
