Evalution of legislative immunity with regard to Penal Law

The LLM thesis entitled ?Evaluation of Legislative Immunity with Regard to Penal Law? by Mr. Mehmet Tunç who is currently studying towards his LLM degree in the Department of Public Law, the Institute of Social Science, Gazi University, was completed in 2010.In the thesis, the Legislative Immunity, which is codified in article 83/2.,3.of the constitution, has been evaluated with respect to penal law. Since the Legislative Immunity serves the purpose of enabling members of parliaments to operate their legislative activities without any disruption, it merely consists of postponing their trials for criminal actions after cessation of them being a member of the parliament.Legislative Immunity is not a prerogative but an institution which has arisen from the very nature of parlamentarian system. It has been criticised because of the way it is codified by the constitution and its extend being too large and the fact that is difficult to lift up.
