Abstract (EN)

It is accepted that public cervants, who play a leading role in the public service provided by the state, have the right to leave public service. The principles to be followed in the exercise of this right of public cervants vary according to profession groups. The right to resign from public service of public cervants working in higher education institutions is examined in our study. In addition to the right to resign, the right to be deemed to have resigned, which is a different reflection of this right, is also discussed in our study. These two states of quitting the duty are compared with other states that terminate the public duty and the differences are revealed. Resignation is a right, that can divided into two types: voluntary and compulsory. In the light of the legal regulations, the reasons for and implementation of the two types of resignation are emphasized. Following the examination of resignation and being deemed to have resigned, the consequences of resignation and being deemed to have resigned in terms of the administration and the public cervant have been revealed and analyzed. All examinations have been made in line with the provisions of the legislation and supported by judicial decisions.
