The comparison of Yusuf al-Qaradawi's minorities jurisprudence theory with the classical Islamic jurisprudence

The study, which aims to compare Qaradawi's fatwas on minority jurisprudence with classical jurisprudence, consists of two parts, apart from the introduction and conclusion parts. In the first part, Qaradawi's life, minority jurisprudence and concepts, and Qaradawi's understanding of minority jurisprudence are examined. In the second part, Qaradawi's fatwas on minority jurisprudence in his work fī Fiqh al-Aqalliyāt al-Muslima are compared with classical jurisprudence sources, specific to four schools of thought, in terms of evidence and utilization of evidence. Document analysis and comparison methods are used in the study. As a result of the comparison, it has been determined that Qaradawi's fatwas and approaches in this field aimed to ensure that Muslim minorities could easily practice their religion and to present the most appropriate jurisprudential provisions for them in this context, that in line with this goal, he made use of the existing jurisprudential accumulation and made various ijtihads and put forward new views, that as a natural result of this goal and method, there was no harm in a Muslim woman continuing her marriage with her non-Muslim husband, that a Muslim could inherit from a non-Muslim, and that he created a unique understanding of jurisprudence of minorities by granting permission to Muslim minorities in many issues that were not permitted in classical jurisprudence. As a result of the study, it was concluded that Qaradawi's understanding of jurisprudence of minorities differed greatly from classical jurisprudence in terms of its method and the results it reached.
