Abstract (EN)
Even though insurer is exempted partially or fully from the obligation to pay against policy owner who deal with insurer, this matter cannot be proposed in a case against an injured party according to article 1484 of Turkish Commercial Code acted under titled "obligation to pay to the injured party" in compulsory insurance. This article is regulated in the protective purpose of injured party and it will find application in compulsory liability insurance. Our study includes the article's terms of realization, the condition of the insurer and the defense of insurers, article's application. In this scope, will be explained what is happening in the way of protection of victims and it will be discussed the purpose of protection injured party in compulsory liability insurance.
