Abstract (EN)
Nowadays, the spread of theft crime and punishment of the theft act is taken as the basis of the Turkish Criminal Code numbered 5237. In this thesis study consisting of four chapters, the first part deals with the legal benefit protected by the theft crime, and then the elements of the crime are examined. In the same section, after the elements of the crime are mentioned, the forms of the crime are examined. In the second part, the qualified cases which require more severe punishment than the crime basic form are explained. In the third chapter, the value of the goods which require no punishment or the reduction in the punishment given, the use of robbery, the reasons of personal impunity and effective repentance are examined. In the last part, the difference between the criminal sanction and the prosecution and the similar crimes of the crime is emphasized. In addition to this, we have included changes in the way we work, the judicial views and opposing views of the teachers, these opinions are compared with the high judicial precedents, and our opinions are also included in our work
