Abstract (EN)

The thesis consists of four chapter that concept of the criminal law, crime and punishment policy, principles of criminal law and historical development of criminal law in terms of criminal capacity are examined in the first one. In the second part of thesis, general information about crime and fault, motive imperfection and the circumstances affecting the defect, ( only the mental illness section is explained) historical development of mental disorders in terms of criminal responsibilities, the criminal systems regarding mental illnesses and the ways in which mental illnesses are regulated in the penal laws have been examined and explained in detail. In third chapter are examined that the concept of personal disorder, psychopathology and crime behaviour, cluster A personality disorders, cluster B personality disorders, cluster C personality disorders and if antisocial personal disorder that one of the cluster B personality disorders is covered or not by mental illness. The regulations on personal disorders that are covered by mental illness in terms of criminal and criminal procedure law, procedures and principles in the detection of mental illness, criminal liability in personal disorder within the scope of sociopathy and psychopathy, preventive measures for mentally ill offenders, the concept of treatment as a preventive measure and high-secured medical institution, the place of the mental patient and the crime mental patient in the international medical declarations, high-secured medical institutions that treated mentally ill offenders all around the world are examined in the last and fourth chapter of this study.
