Abstract (EN)
EUROPEAN UNION E-COMMERCE LAW AND THE DIGITAL FUTURE This study examines the legal framework of e-commerce, which has been rapidly developing under the influence of digitalization, in the context of the European Union (EU) and Turkey, and examines regulatory approaches in the light of judicial decisions. The basic principles and elements of e-commerce are evaluated together with the effects of digitalization in this area. In the study, the general principles of e-commerce in EU law are examined, while legal regulations are analyzed in the context of consumer rights, legal status of service providers, contract law and tort law. In the evaluations made in the light of judicial decisions in the EU and Türkiye, the approaches of different legal systems to e-commerce regulations are evaluated comparatively. The jurisprudence of the courts in the European Union is examined in the context of legal regulations such as the Digital Services Act (DSA) and the Digital Markets Act (DMA), and the legal aspect of e-commerce is analyzed in depth. In the context of Turkey, the level of compatibility of the country's current regulations and practices with the European Union is examined through the relevant legislation and judicial decisions. As a result, this study discusses the legal framework required for the effective and fair regulation of e-commerce by revealing how the law is shaped in the changing trade environment with digitalization.
