Protection of related rights

The subject of the dissertation is "Protection of Related Rights". Related rights are rights held by performers, phonogram producers, radio-television organizations and film producers operating on a work or intellectual product. Associated with their qualifications, these rights emerge as a consequence of an intellectual effort. This intellectual effort is protected by Law No. 5846 on Intellectual and Artistic Works. In this context, within the framework of the Law No. 5846, types of related rights, owners of related rights, the authority arising from related rights and legal cases that are designated for the protection of related rights are discussed. This study is comprised of four sections. In the first section, the concept of related rights and the basic concepts related to these concepts are mentioned. In addition, the historical development of the protection of related rights and important international conventions on this subject are given in order to sake of clarity the place and development of the concept of related rights in Intellectual Law. The second section, the related rights owners and the conditions stipulated in the Law for the protection of these persons as related rights owners are explained in accordance with the Law systematic. In the third section, the moral and financial rights of the related rights owners, who meet the conditions stipulated in the Law, are examined respectively. In the fourth and final section, the legal cases that the related rights owners can apply in case of infringement of related rights are discussed in detail, supported by doctrinal opinion and Supreme Court decisions in terms of qualification and procedural.
