Abstract (EN)
International judicial cooperation, defined as the execution of legal actions by the judicial authorities of one state on behalf of the judicial authorities of another state in criminal matters, constitutes a continually expanding area in scope and application at the present time. Increased mobility of individuals and goods, along with advancements in transportation and communication networks, have resulted in a rise in judicial cases involving foreign elements. This development has necessitated inter-state judicial cooperation. Judicial cooperation in criminal matters, a subset of international criminal law, facilitates the progress of ongoing trials within a state while also addressing issues of impunity and the perception thereof. The initial instances of such cooperation primarily involved extradition; however, additional forms of cooperation have been adopted over time in response to evolving needs. One such emerging mechanism is the transfer of proceedings. Under bilateral or multilateral international agreements designed to ensure the uninterrupted continuation of legal proceedings states may transfer an investigation or prosecution to another state with the capacity to effectively proceed or conclude it. This form of judicial cooperation is distinguished by its intersection with state sovereignty. The transfer of proceedings entails the delegation of judicial authority—an inherent aspect of sovereignty—to another state. Consequently, the receiving state acquires supplementary judicial authority over an offense committed beyond its territorial jurisdiction. Given its sensitive nature, the transfer of proceedings is less frequently employed compared to other judicial cooperation mechanisms. Moreover, its practical implementation remains relatively underrecognized. Despite these challenges, the transfer of proceedings continues to evolve as a significant instrument of judicial cooperation, serving as a critical tool in modern society's efforts to combat crime and ensure accountability.
