Sexual harassment

The crime of sexual harassment, which means the harassment of a person for sexual purposes without violating their bodily inviolability, is a consequence of gender inequalities, as in other crimes against sexual freedom. For this reason, in the first part of our study; gender, sexual freedom, sexual violence, domestic violence and violence against women, international and national regulations and national action plans in combating violence, the Istanbul Convention and Turkey's position on the convention, statistics on sexual harassment incidents, the crime of stalking, which has similarities and differences with the crime of sexual harassment but is included in the concept of sexual harassment in some countries. In the second part of our study; the history of the crime of sexual harassment in the Turkish Penal Code, how the crime is regulated in comparative law, the legal value protected by the crime in the Turkish Penal Code, the elements of the crime, special forms of appearance, the judgment and sanction of the crime, and the issue of proof, which constitutes an important problem in terms of the crime of sexual harassment, are included, and the topics are tried to be explained in the light of the discussions in the doctrine and the decisions of the Court of Cassation.
