Abstract (EN)
This thesis, titled "Assessment of Judicial Decisions Regarding Child Custody in the Context of Legal Culture", examines judicial decisions regarding child custody from the perspective of legal culture. The inconsistency between legislation and judicial practice is a fact that we cannot ignore in our country as well as in the rest of the world. In particular, facts such as the definition of law, its purpose, making sense of law, and the cultural and ideological dimensions of law are very important for us to make sense of the law applied within the borders of a country and to analyze it correctly. For this purpose, after explaining and examining the concepts such as culture, legal culture, reception, and enactment in the first part, we will try to analyze these judicial decisions in the second part with the conceptual framework that we tried to put forward in the first part, and what we should understand from law and how this concept should be explained, and we will try to conclude that how we should define it.
