Child sexual abuse

This is the subject of the thesis, Turkey frequently experienced and society constitute the crime of sexual abuse of children by seeing too much response. The crime of sexual abuse is addressed in the 103rd article in the "Crimes Against Sexual Immunity" section of the "Crimes Against Persons" section of the New Turkish Penal Code No.5237. The child's age, psychology and consciousness of the child are important for the commission of the crime. In addition, the amount of punishment to be determined according to the nature of the sexual acts applied to the child varies. For example, sexual behaviors involving contact with the child's body constitute the simplest form of the sexual abuse crime of children, if the act reaches the dimension of sexual intercourse, a qualified version of the sexual abuse crime will emerge. These issues have been tried to be dealt with in detail in the thesis. In our study, the problems in the regulation and the problems encountered in practice were handled within the framework of the decisions of the Supreme Court. The types of sexual behavior within the scope of the crime and the differences according to age groups in the regulations were examined and discussed in detail. Especially by emphasizing children's sexual behaviors towards each other and their actions up to the extent of sexual intercourse, the problems encountered in the Law and in practice were addressed, and within this framework, it was aimed to contribute to the controversial issues related to crime.
