Abstract (EN)

The subject of work is the Presidential Decree in the Presidential System of Government. This study consists of three parts. In the first part, the decree and its types will be discussed first. Then, government systems will be discussed from a political and legal perspective. In addition, the decree practices in government systems, government systems in Turkey from the Ottoman Empire to the present day will be discussed. The 1921 Constitution was adopted by the parliamentary system of government, while the Constitutions of 1924, 1961 and 1982 adopted the parliamentary system. Presidential system discussions started in the second half of the 1980s. The Constitutional amendment made on 21 October 2007 also paved the way for the implementation of this system. In the second part, the administrative structure of the Presidency, which is the executive wing of the new government system, and the duties and powers and operations of the president, who is the head of the executive, are mentioned. In particular, the subject, scope, place in the hierarchy of norms and legal control of the Presidential decree were mentioned.
