Abstract (EN)
Associations are legally recognized non-governmental organizations. Absenteeism within their rights—a human-specific state of disappearance in the event of death or imminent danger—cannot be determined. Associations are also organizations centered on a specific goal. In this situation, they are able to carry on as long as they achieve their goals. Associations are not guaranteed to remain in existence indefinitely just because they are continuous. As a result, associations will inevitably end, just like any other thing or personality. The master's thesis focuses on the reasons for terminating associations. Within this framework, three reasons for the termination of an association are identified: spontaneous termination, termination by decision of the general assembly, and termination by court order. The consequences may differ depending on the reasons for the dissolution of an association. This framework briefly discusses the consequences of the termination of associations. The second part of the thesis conceptualizes and explains the reasons for the dissolution of associations in general, examining the provisions and relevant legislation to which associations are subject. The third chapter is devoted to a detailed discussion of the reasons for association termination. This chapter is divided into three sections: termination by general assembly decision, termination by spontaneous decision, and termination by court decision. The fourth segment examines the effects of association termination. This segment also delves into the intricacies of the liquidation process, delineating the allocation of property and assets in accordance with the underlying reasons for termination. The final chapter offers a conclusion that synthesizes the salient points of the thesis. Finally, civil society organizations are inevitable and essential under modern democratic regimes of law. As a result, the reasons for termination of connections should be read narrowly. This will ensure the freedom to form associations and the ability to survive.
