Abstract (EN)

The family is the smallest unit of the society that is formed by the individuals to live together. There are rules to be established and followed in order to continue life together in sustainable and healthy manner. In doing so, a head of household is assigned to provide communication among family members without discrimination. Besides to ensure domestic order and control, the head of house is also totally and ultimaltely responsible for the damages they may cause to those; young ones' in the family, The one with legal restriction, the one with the mental illness or defectiveness and third parties. There is no legal way to justify himself. The subject is examined in three sections in this study. In the first part, the introduction of the head of the house, the definitions of the concepts of family and head of house hold, the history of the head of house hold, the occurrence, conditions, authorities and duties are discussed. In the second part, liability, scope and terms of liability are discussed. In the third and last part, the provisions and consequences of the liability such as compensation and recourse are included. In this study, additional new regulations were examined. It was also examined within the framework of the Turkish Civil Code - Turkish Code of Obligations No. 6098, Judicial Decisions, Doctrine. From time to time, it was examined in the framework of the Turkish Code of Obligations No. 818.
