Investigating the problems faced by physicians in terms of defensive medicine

Nowadays, the relationship between patient and physician is not efficient enough due to both the weight of working conditions in the health sector and the small number of service providers according to demand. Parallel to the developments in human rights all over the world, patient rights have developed and the patient-physician relationship has to change and become high quality. This process constituted the concept of "defensive medicine aimed at self-protection of physicians. Defensive medicine briefly; physicians do not face legal cases and penalties, do not face any compensation and unnecessarily use both diagnostic and therapeutic medical practices by acting too overprotective or timid to increase insurance premiums. This attitude also includes avoidance of practices that are likely to result in malpractice proceedings. In this study, it is aimed to investigate the problems faced by physicians during their profession in terms of defensive medicine. The study consists of four theoretical parts. In the first chapter, medical concepts and definitions are given. Malpractice, indication, complications and legal concepts of medicine are emphasized. The concepts of health law, medical law and medical intervention are examined in detail. In the third chapter, a large literature review is made about what the rights of both patients and physicians. In the last part of this section, both the rights and responsibilities of the physicians and the criminal obligations arising from their responsibilities are examined. The definition of defensive medicine, the history of defensive medicine practice and the literature on positive and negative defensive medicine concepts have been searched and these concepts have been tried to be explained. In addition, comparative results of quantitative, quantitative defensive medicine studies are presented in tables.
