Abstract (EN)
ABSTRACTAs a result of social state understanding, while health service has begun to fulfilled bystate administration compensating of detriment comes from administrative activity hasbecome a main topic of administrativ law. The basic goals of health service offered by stateadministration are to keep person or public healthy and to obtain health that was lost before.Because of continous development in medicial science, health service, given byadministration, scope is getting larger. As a result of absence of legal regulation, detrimentneeds compensation or acceptable detriment doesn?t need compensation determines inaccordance with The Council of State sentencesIn respect of Constitution, administration has to compesate detriment comes from itsactivity. For that reason, while administration fulfills public servises person who is demagedcontrarily to law must be compesated. Administrative responsibility results from healthservice is indipendent from officials? flaw.Whit this study we aim to examine and evaluate distinctive speciality of administrativecompensatory responsibility of health service as a subdimision of general administrativeresponsibility.
