The crime of zoning pollution

The aim of our thesis is to examine of the "crime causing of development pollution" regulated in Article 184 of the second section entitled "Crimes Against the Environment" which is in the second part of the third section of Turkish Penal Code numbered 5237, "Crimes Against Society" and the creation of awareness of the fact that the development pollution, as a result of an uncontrolled immigration from the village to the city as a result of trying to overcome the increased need for shelter in an uncontrolled way, is a kind of environmental pollution. In the first part of our thesis, the basic concepts of zoning pollution are examined for understanding the zoning pollution crime. The necessity of the application of criminal law in the crime of causing pollution of the environment and zoning pollution, which is our thesis topic, was emphasized. In the second part of our thesis, three separate offenses listed in three separate paragraphs of Article 184 were evaluated in accordance with the "examination of the classical crime type method". The legal value protected by the crime stated in the Article 184 is the right to live in a healthy and balanced environment. The victim of this crime is everyone who constitutes society. The perpetrator of the crime is examined separately for each crime in the three separate paragraphs and can be committed intentionally. At the end of the second part, after the special appearance of the crime, the reasons that remove or reduce the defect are discussed. In the third part of our thesis, the sanction of the zoning pollution crime, the reasons which abolish or reduce the penalty and the court authorized and charged with the crime are examined. In our thesis, the views in the doctrine are taken into consideration and the subjects are tried to be detailed by specifying our opinion.
