Abstract (EN)

Along with the increase in the number and variety of unmanned aerial vehicles, the interaction with humans has also increased. In terms of law, this requires the determination of the principles of responsibility arising from unmanned aerial vehicles. In Turkish law, unmanned aerial vehicles are divided into state unmanned aerial vehicles and Turkish civil unmanned aerial vehicles. Our study focuses on Turkish civil unmanned aerial vehicles. As a result of activities carried out with Turkish civil unmanned aerial vehicles, third parties may suffer damages, leading to the emergence of many types of responsibility in liability law. In our study, the liability of the operator of a civil aircraft regulated in Article 134 and subsequent provisions of the Turkish Civil Aviation Code No. 2920 has been examined. According to Article 138 of the Turkish Civil Aviation Code No. 2920, Article 6 of the Regulation on Third-Party Liability Insurance for Civil Aviation, and Article 10/2 of the Instruction on Unmanned Aerial Vehicle Systems, the operator of an unmanned aerial vehicle must insure their liability arising from the operation of the unmanned aerial vehicle. In our study, the insurance that the operator of an unmanned aerial vehicle is required to obtain has been explained within the scope of the Turkish Commercial Code No. 6102 and the Regulation on Third-Party Liability Insurance for Civil Aviation.
