Abstract (EN)

This study, which examines the legal liability of occupational safety specialists, is structured into three main sections. Section one focuses on occupational health and safety, emphasizing its significance and, explores the concept of workplace accidents and occupational diseases. Section twooutlines duties, authorities, obligations, legal status and professional independence of occupational safety specialists. It also evaluates the regulatory framework established under Law No. 6331 on Occupational Health and Safety and, as well as the provision of the Regulation on the Duties, Authorities, Responsibilities and Training of Occupational Safety Specislists enacted pursuant to this law. Section three provides a detailed analysis of the legal liabilities of occupational safety specialists. It examines their responsibilities toward employers, other employees and Social Security Institution. The section also addresses the implications of specialists working within joint health and safety units. Furtermore, it investigates whether employees who suffer a workplace accident or occupational diseases may directly pursue compensation claims against occupational safety specialists. The ways in which occupational safety specialists may be exempted from liability have been examined.
