Abstract (EN)
Since the early years of humanity, the use of the family institution has led to its significant place in the legal field. Due to its important position, family law holds a special place in every society. In Islamic law, however, family law occupies an even broader space. This reflects the importance that Islam places on the family. Significant changes in the structure of societies have also necessitated updates to certain formal requirements in family law. This is because the oral culture that was valid in ancient societal structures no longer has a counterpart today. As a result, family law, which was built upon oral culture, has needed certain modifications. In this study, we will particularly address the social changes that have occurred in our country over the past century and evaluate the interventions of state authority in family law from the perspective of Islamic law.
